Dr. Atthachai Homhuan is one of Thailand’s leading experts on the law regulating cannabis and other hemp-related products. A licensed attorney with a PhD in Pharmaceutical Technology, Dr. Atthachai is sought after by the world’s leading cannabis companies to advise on all aspects of establishing and operating their business in Thailand.
Since the liberalization of cannabis laws in Thailand in 2019, he has assisted numerous clients at various stages of their business operations, from cultivation through to product manufacture and export. Combining legal and scientific expertise, Dr. Atthachai provides strategic advice on a wide range of matters, including corporate establishment and structuring, business collaborations, intellectual property, technology transfers, and R&D, as well as the import and export of cannabis products, seeds, crops, and fertilizers.
With particular expertise in the complex and fast-changing regulatory framework, he has helped clients obtain licenses and approvals from the Thai Food and Drug Administration (FDA) and the Department of Traditional and Alternative Medicine (DTAM). He acts for companies producing a wide range of cannabis-related products, including industrial, nutraceutical, and pharmaceutical products, as well as traditional medicines. He also regularly provides strategic advice to businesses on the potential impact of the Cannabis and Hemp Act, a draft bill currently under consideration which would restrict the manufacture and sale of cannabis-related products to those with a medicinal purpose.
Dr. Atthachai has advised several global cannabis and life sciences companies on the establishment of joint ventures and local subsidiaries to engage in the cultivation, manufacture, sale, and distribution of cannabis products in Thailand. In collaboration with Tilleke & Gibbins’ Laos office, he has also advised clients on the establishment of representative offices in that country, as it explores the potential liberalization of its cannabis laws.

- Advised several of the world’s leading cannabis companies on structuring business partnerships and joint ventures in Thailand with the assistance of Tilleke & Gibbins’ corporate and commercial team, and provided guidance on related technology transfers, registered and unregistered IP, and trade secrets.
- Assisted Thailand’s regulatory authority with translating the Narcotics Act and relevant cannabis regulations.
- Assisted various international life sciences companies with establishing operations for medical cannabis and cannabidiol (CBD) products, from farming and cultivation to product launch.
- Arranged high-level meetings between representatives of the Australian and Canadian Cannabis industry with key thought leaders in the cannabis industry in Thailand.
